On June 21, 2024, the Texas Supreme Court rendered a final judgment in favor of Snell Law’s client against the State of Texas and reversed a trial court judgment awarding over $16,000,000 under the Texas Medicaid Fraud Prevention Act. (A copy of the majority court’s opinion is linked here.)
Although the lawsuit began in 2012 and had accumulated over 7 years of litigation activity involving voluminous discovery, Snell Law was not hired until 6 months before the case was set for trial and had to immediately engage in summary judgment proceedings. Snell Law never got the chance to defend its client at trial because the court granted a summary judgment awarding over $16,000,000 in fines, penalties, and fees based upon irregularities in reimbursement forms submitted to Medicaid.
While greatly outmatched in manpower and resources, the team at Snell Law persevered and fought against the Texas Attorney General’s office through adverse rulings in the trial court and lower appellate court to finally prevail on behalf of its client.
