On Thursday, May 9, after a four-day jury trial in Travis County District Court, the Snell Law Firm secured a jury verdict in favor of its clients, Eli and Clare Chan. The jury’s verdict, returned late in the evening, awarded the Chans their economic damages and additional damages for one of the defendant’s knowing and intentional violations of the Texas Deceptive Trade Practices Act. The trial included testimony from six fact witnesses and one water intrusion expert.
In the Summer of 2012, the Chans purchased their home from Defendants. Defendants bought the home from the original builder and occupied the home for more than a decade. During the sales process, the Defendants failed to disclose known defects and work done to the home’s stucco cladding. More than four years after the Chans purchased the home, they discovered extensive damage to and work performed on the home’s stucco. Later investigative work revealed pervasive damage to the home and defects in construction. The jury’s verdict ends a lengthy battle between the parties in the Chans’ favor.
Judge Jan Soifer of the 345th Judicial District Court in Travis County presided over the trial, which was the culmination of a hotly-contested battle between the parties.
