On Tuesday, May 15, after a two-day bench trial in Travis County Court at Law, the Snell Law Firm obtained a verdict in favor of its client, Richard Keating. The Court’s verdict was a complete victory and awarded Mr. Keating all of his economic damages, consulting fees, and attorney fees. The trial included testimony from three fact witnesses and three construction experts. Attorney Lance Cawthon led the Snell Law Firm\’s trial team along with attorney Jason Snell. In awarding damages, Judge Todd Wong ruled from the bench Defendants had violated the Texas Deceptive Trade Practices Act.
In the Spring of 2016, Mr. Keating purchased his home from Defendants. Defendants were the original builders and occupants of the home. During the sales process, the Defendants represented there were no known defects to the home’s stucco or windows. However, only a few days after closing, rainy weather resulted in extensive water intrusion and damage to Mr. Keating’s home. Later investigative work revealed pervasive damage to the home and defects in construction. The Court’s verdict ends a lengthy battle between the parties in Mr. Keating’s favor.
