On Friday, October 28, after a lengthy legal battle and a bench trial in Travis County District Court, the Snell Law Firm obtained a victory for clients David and Wendy Salazar, who were sued over a home they sold in 2013. Travis County District Court Judge Karin Crump also awarded the Salazars more than $33,000 in attorney fees they incurred in defending the lawsuit.
The Court’s judgment, which arrived after the conclusion of a trial earlier in the week, ends a three-year lawsuit brought by Plaintiff Catherine Lara, who sued the Salazars for breach of contract, violations of the Deceptive Trade Practices Act, fraud, and negligence. Lara accused the Salazars of failing to disclose foundation defects in their home prior to its sale.
During the day-long trial, Defendants’ Attorneys Jason Snell and J.R. Skrabanek of the Snell Law Firm demonstrated to the Court that the Salazars did, in fact, disclose everything they knew based on information provided to them by their foundation repair contractor. Because the Salazars prevailed on Plaintiff’s claims, the Court awarded the Salazars their attorney’s fees pursuant to the standard Texas real estate contract, which mandates that a prevailing party must be awarded its attorney fees.
